ABCC vs Ark Tribe

Update Monday June 21: Ark's trial was adjourned on Friday afternoon and will continue in the Adelaide Magistrate's Court July 20-22.
In court on the morning of June 15, Ark's defence team argued that the case against him be thrown out because the ABCC officer who laid the charges does not have the authority to do so. The magistrate called for written submissions and will announce his decision at 2pm on Wednesday July 16.
If the challenge to the ABCC's handling of the case is successful, Ark will walk from the court a free man. If the magistrate dismisses the challenge the trial will proceed as normal.

The Main Event - ABCC vs Ark Tribe
On June 15 the trial of Ark Tribe for refusing to attend an Australian Building and Construction Commission interrogation began in the Adelaide Magistrate's Court.
- Construction Workers' Protest Embassy outside the ABCC offices, 355 St Kilda Road, from 7am Tuesday June 15 for duration of trial

If found guilty Ark faces 6 months jail and a $22,000 fine.
The attack on Ark Tribe by the ABCC is an attack on the rights of all Australian workers. The criminalisation of union activity, particularly over OH&S, must stop!
Important facts about Ark’s case:
- The ABCC wanted to grill him about a stoppage over poor safety that lasted a few hours. (The builder responded by locking workers out on Saturday).
- Workers had been on to the builder for a while to have safety brought up to standard.
- Safework SA attended and backed up the workers, issuing notices against the builder.
- The ABCC targeted the case to intimidate construction workers out of taking strong action on safety.

- Bring delegations to the Don’t Jail Ark tent embassy during the trial @ 355 St Kilda Road
